About our privacy policy

Bata Industrials cares a lot about your privacy. We therefore only process data we need for our services and their improvement and manage the information we collect about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Bata Industrials. The effective date for the validity of these terms is 15/10/2021. With the publication of a new version, the validity of all previous versions expires. This privacy policy describes what information we collect about you, what this information is used for, and with whom and under what conditions, if any, this information may be shared with third parties. We also explain how we store your data and how we protect it against misuse, and what rights you have in relation to the personal data you provide to us.

About data processing

Below you can read how we process your data, where we store it, what security techniques we use and who has access to the data.

Email and mailing lists

MailChimp

We send our email newsletters using MailChimp. MailChimp will never use your name and email address for their own purposes. At the bottom of every email sent automatically through our website you will see the ‘unsubscribe’ link. If you unsubscribe, you will then no longer receive our newsletter. Your personal data is stored securely by MailChimp. MailChimp uses cookies and other internet technologies that provide insight into whether emails are opened and read. MailChimp reserves the right to use your data to further improve its services and to share information with third parties for this purpose.

Office365

We use the services of Office365 for our regular business email traffic. This party has taken appropriate technical and organizational measures to prevent abuse, loss and corruption of your and our data as much as possible. Office365 does not have access to our inbox and we process all our email traffic confidentially.

Purpose of data processing

General purpose of processing

We use your data exclusively for the purpose of providing our services. This means that the purpose of processing is always directly related to the order you make. We do not use your data for targeted marketing. If you share information with us and we use this information—other than at your request—to contact you at a later date, we will request explicit permission to do so. Your data will not be shared with third parties, other than to meet accounting and other administrative obligations. These third parties are all bound to confidentiality by virtue of legal obligation, oath or agreement between them and us.

Automatically collected data

Data that are automatically collected by our website are processed for the purpose of further improving our services. These data (e.g., your IP address, web browser and operating system) are not personal data.

Cooperation with fiscal and criminal investigations

In certain cases, Bata Industrials may be required by law to share your data in connection with governmental fiscal or criminal investigations. In such cases we are forced to share your data, but we will resist this within the possibilities offered by law.

Storage periods

We store your data for as long as you are our client. This means that we keep your client profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret this as a request to be forgotten. Due to applicable administrative requirements, we are required to retain invoices containing your (personal) data. However, employees no longer have access to your client profile and documents that we have generated because of your order.

Your rights

Pursuant to applicable Dutch and European legislation, as a data subject you have certain rights with respect to personal data processed by us or on our behalf. Below we explain what these rights are and how you can invoke them. In principle, to prevent misuse, we only send copies and transcripts of your data to your email address already known to us. If you wish to receive the data at a different email address or, for example, by regular mail, we will ask you to identify yourself. We keep records of processed requests; in the case of requests to be forgotten, we administer anonymized data. You will receive all copies and transcripts of data in the machine-readable data format we use within our systems. You have the right at any time to submit a complaint to the Personal Data Authority if you suspect that we are using your personal data incorrectly.

Inspection rights

You always have the right to inspect the data we process (or have processed) relating to your person or traceable back to you. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data together with a list of the processors holding this data, indicating the category under which we have stored the data, to the email address known to us.

Right of rectification

You always have the right to rectify the data that we process (or have processed) related to your person or traceable back to you. You can submit a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the data have been rectified at the email address known to us.

Right to restriction of processing

You always have the right to limit the data we process (or have processed) related to your person or traceable back to you. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address known to us that the data will no longer be processed until you lift the restriction.

Right to portability

You always have the right to transfer the data that we are processing (or have processed) related to your person or traceable back to you, to another party. You can submit a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send you, at the email address known to us, copies or transcripts of all data about you that we have processed or have processed on our behalf by other processors or third parties. It is likely that we will no longer be able to continue providing services in such cases because the secure interconnection of data files can then no longer be guaranteed.

Right of objection and other rights

You have the right to object, in appropriate cases, to the processing of your personal data by or on behalf of Bata Industrials. If you object, we will immediately stop processing data pending the settlement of your objection. If your objection is well-founded, we will make transcripts and/or copies of the data we process (or have processed) available to you and thereafter stop the processing permanently. You also have the right not to be exposed to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. Cookies

Google Analytics

Through our website, cookies are placed by the U.S. company Google, as part of the “Analytics” service. We use this service to track and get reports on how visitors use the website. This processor may be required by applicable laws and regulations to provide access to this data. We collect information about your browsing habits and share this data with Google. Google can interpret this information in combination with other data sets and thus track your movements on the Internet. Google uses this information to offer, among other things, targeted advertising (Adwords) and other Google services and products.

We reserve the right to change our privacy policy at any time. However, you will always find the latest version on this page. If the new privacy policy affects the way we process data related to you that we have already collected, we will notify you by email.
